Justice Ozzi Hears Arguments, Reserves Decision — Surcharge Remains in Effect
On August 31, Justice Wayne Ozzi of the New York Supreme Court heard more than two hours of oral arguments in the legal challenge to the pied-à-terre surcharge. He did not issue a ruling from the bench. Justice Ozzi reserved decision and gave the parties additional time to submit further briefing. The surcharge therefore continues to operate while the court considers the case. The October 6, 2026 DOF challenge deadline remains in effect and is not affected by the pending litigation.
